ARE TEXT MESSAGES CONFIDENTIAL?

When you send a text message do you still maintain a privacy interest in the received text? It depends. “The subject matter is not the copy of the message stored on the sender’s device, the copy stored on a service provider’s server, or the copy received on the recipient’s device that the police are after; it is the electronic conversation itself, not its components. Even where an individual does not have exclusive control over his or her personal information, only shared control, he or she may yet reasonably expect that information to remain safe from state scrutiny.”

Personal injury lawyer with self-billed ‘golden touch’ facing misconduct allegations – IS THIS MISLEADING?

I’m really kind of curious what non-lawyers think of this.

The Law Society of Upper Canada has served Brian Goldfinger with a notice of application alleging he has “improperly marketed legal services through public advertising and his website.”

Trump Jr invents ‘privilege’ excuse to duck Russia questions – This is whacky and I’m surprised the committee accepted this.

TRUMP JR. INVENTS PRIVILEGE – This is whacky and I’m surprised the committee accepted this. In case you’re confused, solicitor/client privilege is one of confidentiality between a client and a lawyer in consideration of litigation. The privilege is that of the client and can be asserted only by the lawyer upon the instruction of the client. If a third party is present for the discussion, the confidentiality is breached and the privilege does not exist. There is NO privilege just because a lawyer happened to be present.

Donald Trump Jr. claimed in testimony to the House Intelligence Committee that he couldn’t answer questions about what he talked about with his father because of attorney client privilege. What?
